Elijah H. McWhinney, Esq. concentrates his practice in criminal, family and real property matters, including representing landlords in eviction proceedings. Mr. McWhinney is also engaged in estate planning and real estate transactions and works with local municipalities in the area of municipal corporation compliance and litigation.
Representative Cases:
- Secured warrants of eviction and monetary judgments in favor of landlords in nearly fifty (50) summary proceedings.
- Prevailed at trial in defending a father in a post-matrimonial enforcement proceeding in which the mother’s claims were dismissed and the father was awarded attorney fees.
- Prevailed at trial in a custody action representing a mother who was awarded with sole custody of the parties’ child.
- Prevailed at trial in a divorce action representing a husband who was awarded with sixty-five percent (65%) of the value of the marital estate.
- Secured a dismissal of an action for breach of fiduciary duties on behalf of the executrix of an estate by motion to dismiss.
- Participated in the successful mediation of a real property partition action involving several hundred acres of farmland.
